INSTRUMENT HIRE TERMS AND CONDITIONS

I hereby agree to lease a musical instrument as specified on the lease agreement and made available by MusicLinks, on the terms and conditions listed below.

1. I agree that I am committed to either 3 months or 12 months of instrument hire and to have my nominated credit card automatically charged every months for the monthly hire fee.

2. I agree to promptly pay the $150 ($250 for saxophones) security deposit which will be invoiced on application and that the refundable deposit will be returned upon safe return of the instrument to MusicLinks

3. I agree to maintain and keep my instrument in good working order.

4. I agree that the instrument remains the property of MusicLinks

5. I agree to the initial minimum rental period of either 3 months or 12 months and I then agree to rent my instrument on a month by month basis or discontinue this rental agreement.

6. If I wish to cancel my rental, I will email MusicLinks at info@musiclinks.com.au providing at least 30 days notice of cancellation. Failure to provide adequate notice of cancellation will result in a full term’s rental charge.

7. I agree to take out insurance for the musical instrument against fire, loss, theft and /or damage with a reputable and legally licensed insurer.

8. I agree not to sell or offer for sale, assign, pledge, lend or otherwise deal with the musical instrument.

9. I agree that I am responsible for any loss or damage incurred to the musical instrument whilst in my possession.

10. I agree that MusicLinks will be notified of any damage or loss to the musical instrument within a period of no more than 48 hours.

11. I agree that I will pay MusicLinks for the cost of any repairs deemed necessary as a result of loss or damage incurred. Should the musical instrument be deemed not repairable or cannot be located, I will provide payment for the total value of the music instrument. I understand that the value of the instrument will be assessed by MusicLinks and that the assessment is the amount payable in accordance with these terms and conditions.

12. I agree to not attempt to repair or adjust the musical instrument myself.

13. I agree that if a service, check or repair is required, the instrument will be returned to the MusicLinks office, located in St Ives. This may be in person (via appointment) or arranged via a courier at the hirer’s expense.

14. MusicLinks reserves the right to alter the terms and conditions of this agreement and fees associated to this agreement with no less than 30 days notice to the hirer.

15. When you hire an instrument from us it has been checked, serviced and is in good working order. If there is anything wrong with the instrument when you receive it, please contact us immediately. We require the instrument to be returned to us in good working order.

PRIVACY ACT

I acknowledge that under the Privacy Act 1988 the lessor is allowed to and may give to a credit reporting agency personal information contained in this application or otherwise acquired by the lessor concerning the conduct of my credit account. If and to the extent that the lessor does so in a manner and for purposes that conform with the Privacy Act I agree to the lessor obtaining information about my commercial activities and commercial credit worthiness from a business which provides information about the commercial credit worthiness of persons and to the lessor using that information in assessing my application for credit. If and to the extent that the lessor does so in a manner and for the purposes that conform with the Privacy Act I also agree to the lessor giving to and receiving from any credit providers named in this credit application and any credit providers named in a credit report issued by a credit reporting agency, information about my credit arrangements, provided that the information is given or received to asses an application for credit made by me to the recipient credit provider or to asses my credit worthiness. I acknowledge that, subject to the provisions of the Privacy Act, the lessor may disclose to any person any information concerning a credit facility granted to me or the conduct of that credit facility.
